1. Agreement to Terms

By checking "I Agree" at checkout, account creation, or product access, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you do not agree, do not purchase, access, or use EcoWare products.

2. Prohibited Uses

Customers are strictly prohibited from:

  • Leaking, sharing, or redistributing EcoWare firmware, software, or related materials.
  • Reverse engineering, decompiling, or bypassing protections on EcoWare products.
  • Reselling or sublicensing EcoWare products without written permission.

Violations will result in:

  • Immediate termination of product access.
  • Revocation of all warranties and support.
  • No refunds under any circumstances.

3. Refunds and Warranties

Refunds and warranties are strictly limited:

Firmware

Refunds only if EcoWare cannot deliver. Troubleshooting time may reduce or void refund eligibility.

Hardware

Refunds only if defective on arrival. Proof of defect is required; EcoWare may require destruction or return before refund.

Software

No refunds. Non-functional software will be replaced.

Important: Any breach of Section 2 voids all warranties and refund rights.

4. Limitation of Liability

  • EcoWare products are provided "as-is" without warranties of any kind, except those expressly stated.
  • EcoWare's liability is limited to the amount paid by the Customer for the product in question.
  • EcoWare is not liable for indirect, incidental, or consequential damages, including bans, lost profits, downtime, or third-party claims.

5. Indemnification

Customers agree to indemnify and hold harmless EcoWare, its owners, staff, and partners from all claims, damages, or expenses (including attorney fees) arising from misuse of EcoWare products, breach of these Terms, or violation of law.

6. Right to Refuse Service

EcoWare may ban, suspend, or refuse service to any Customer at its sole discretion for violations of these Terms, suspected fraud, abuse, or misuse.

7. Binding Arbitration & Waiver of Class Actions

  • All disputes arising out of or relating to these Terms shall be resolved exclusively through binding arbitration under the rules of the American Arbitration Association (AAA).
  • You waive the right to bring claims in court, including jury trials.
  • You waive the right to participate in class actions, collective actions, or representative claims.
  • Each dispute must be handled individually.

8. Governing Law

These Terms are governed by the laws of the United States and the state in which EcoWare is registered.

9. Changes to Terms

EcoWare may update these Terms at any time. The newest version will always be posted here. Continued use of EcoWare products constitutes acceptance of the updated Terms.
